ROCKVILLE, Md. (AP) ? Police in Maryland pulled over a motorist dressed as Batman, but the caped crusader escaped without a ticket.
Authorities pulled over the driver of a black Lamborghini with Batman logo tags last week in Silver Spring outside Washington. The driver was dressed as the Dark Knight ? cape, mask and all. Police, however, weren't impressed and wanted to talk to him about his superhero logo license plate, which isn't an approved plate in the state.
The driver, who goes by Lenny B. Robinson when not dressed as a superhero to visit sick children at hospitals, was able to show them a proper license plate for the car. A video of the stop shows police officers shaking his hand and taking pictures of him with his ride.

Targeted medications effective at clearing skin condition

Two experimental drugs given to patients with psoriasis can clear the skin condition?s characteristic thick, dry, red patches at unprecedented rates. The finding paves the way for the long-term clinical trials required for regulatory approval of the medications.
By toning down a key immune protein, the drugs wipe out many psoriasis plaques while showing few signs of side effects. Studies of the two drugs appear in the March 29 New England Journal of Medicine.
Provided major adverse effects don?t turn up in long-term tests, the two medications have a bright future, says Andrew Blauvelt, an immunologist and dermatologist at the Oregon Medical Research Center in Portland. ?So far, these are looking like great drugs.?
Craig Leonardi, a dermatologist at the Saint Louis University School of Medicine, was part of both teams that tested the drugs, called ixekizumab and brodalumab. He and other researchers scored the severity of the patients? psoriasis based on precise measurements of skin affected by the hallmark red plaques. A successful drug reduces a patient?s severity score by 75 percent.
All volunteers had had moderate to severe psoriasis affecting at least 10 percent of their bodies for six months. In one of the studies, Leonardi and his colleagues randomly assigned 142 patients to receive either ixekizumab or a placebo. In the other, 198 patients got brodalumab or placebo. In both studies, drugs and placebo were delivered as several injections spaced over 12 to 16 weeks, using various doses.
Both drugs reduced the psoriasis severity score by 75 percent in about four-fifths of patients getting a medium to high dose of either drug.
The drugs thwart the immune protein interleukin-17. In most people this protein plays a productive role, fending off bacterial and fungal infections, Blauvelt says. But people with psoriasis overproduce interleukin-17, which induces activation and growth of the outer-layer skin cells that make keratin. Only long-term testing, some of which is already under way, will establish that interleukin-17 activity can be suppressed by these new drugs indefinitely without risk of infection, Blauvelt says.?
Each study was funded by the drug?s manufacturer. Eli Lilly makes ixekizumab, and Amgen makes brodalumab.
Blauvelt says the new results compare favorably with previous early-stage studies of drugs that also target immune system proteins implicated in psoriasis. Some of these drugs have reached pharmacy shelves as etanercept (Enbrel), adalimumab (Humira) and ustekinumab (Stelara).
The last 10 years have seen ?a very profound shift in the approach to treatment of psoriasis,? says dermatologist Kim Papp of Probity Medical Research, in Waterloo, Ontario, Canada, and coauthor of the brodalumab study.
And the targeted approach has vastly improved options for patients, Leonardi adds. ?Fifteen to 20 years ago was still the therapeutic Stone Age [for psoriasis treatment] with the use of coal tar and ultraviolet light,? says Leonardi, who reports consulting for Amgen, Eli Lilly and other companies. He envisions that the two new drugs, if approved, will be lifelong injectable medications ? just as insulin is for diabetes. ?Chronic diseases require chronic therapies,? he says.

Lifetime care of individuals with autism highest for those with intellectual disability $2.3 million US and 1.5 million UK
New York, N.Y. Autism Speaks, the world's leading autism science and advocacy organization, today announced preliminary results of new research that estimates autism costs society a staggering $126 billion per year (U.S.) a number that has more than tripled since 2006, and annually in the U.K. has reached more than 34 billion (equivalent to $54 billion U.S.). The costs of providing care for each person with autism affected by intellectual disability through his or her lifespan are $2.3 million in the U.S. and 1.5 million ($2.4 million) in the U.K. The lifetime costs of caring for individuals who are not impacted by intellectual disability are $1.4 million in the U.S. and 917,000 in the U.K. (equivalent to $1.46 million). The Autism Speaks-funded research, conducted by researchers Martin Knapp, Ph.D., of the London School of Economics, and David Mandell, Sc.D., of the University of Pennsylvania, will be presented at the international conference "Investing in our Future: The Economic Costs of Autism," hosted by Goldman Sachs in collaboration with the Child Development Centre and Autism Speaks, on March 31 in Hong Kong.
Drs. Knapp and Mandell compiled information from recent studies of autism costs from multiple sources to calculate the current cost of autism associated with the current CDC-reported prevalence that 1:110 children are diagnosed with an autism spectrum disorder (ASD). The cost of autism continues to grow with the rise in prevalence. While the latest prevalence estimates in the U.S. and U.K. are comparable, the primary difference in total costs of autism in the U.S. and U.K. are due to differences in total country population (five times larger in the U.S. than the U.K.). The research team found that the cost of autism in the U.S. alone is greater than the entire Gross Domestic Product (GDP) of 139 countries around the world.
Bob Wright, co-founder of Autism Speaks, said, "Autism is a global public health crisis. The costs are staggering and will continue to rise as prevalence continues to increase. We know that early diagnosis and treatment are critical, so it is imperative that the U.S. and governments around the world step up their commitment to helping people living with autism today. The investment we make now is essential to reducing the long-term costs of autism."
This research found that intellectual disability plays a major role in the cost of autism to individuals, families, and society as a whole. The costs of autism per year are nearly twice as high on average for children and adults with intellectual disability than for children and adults without intellectual disability, $2.3 million in the U.S. and 1.5 million in the U.K. ($2.4 million) for those individuals who are impacted by intellectual disability compared with more than $1.4 million in the U.S. and 917,000 ($1.46 million) in the U.K. for those who do not have intellectual disability.
A number of factors were considered by the researchers that contributed to the cost differential between U.S. and U.K. lifetime and total costs. The education and healthcare systems in the two countries offer different responses to the needs of people with autism and their families. Access to empirical data regarding healthcare and education costs differed between the two countries. It is also currently estimated that 45 percent of individuals with ASD in the U.S. and 55 percent of individuals with ASD in the U.K. have intellectual disabilities, defined as an IQ of 70 or less. Experts consistently point to early interventions as key to increasing language and IQ scores, and reducing life span costs.
Total costs to the U.S. were also based on adult prevalence of one-half of one percent, lower than currently estimated 1:110 prevalence of autism in children, derived from past CDC studies. The researchers point to adult prevalence as an area for additional study in the U.S.
The research also found that non-medical costs account for the greatest proportion of expenses. While direct medical costs, such as outpatient care, home care, and pharmacy, contribute significantly to overall expenses, non-medical costs, including intervention services and special education, child daycare, and especially residential placements and care for adults who age out of school and can no longer live at home with parents account for the largest proportion of autism costs.
"The burden on families affected by autism is enormous," continued Autism Speaks President Mark Roithmayr. "The extraordinary cost further exacerbates that burden. The time and effort involved in coordinating the care and treatment plan across a large number of providers has reduced the ability of many families to earn a living. Too many families are still denied insurance coverage for essential treatments and services, and the economics add to overall emotional burden on families."
Building on this preliminary research, Autism Speaks recently provided additional funding to Drs. Knapp and Mandell to support an additional year of study to examine how autism therapies reduce lifetime costs associated with autism. Their investigation will focus on both intensive preschool behavioral interventions and vocational interventions that support an individual's independence during the transition to adulthood. Calculations will take into account costs related to healthcare, education, caregiving, housing, and employment.
As confirmed by this study, the majority of costs related to autism are incurred during adulthood, principally due to the cost of residential care as well as loss of productivity, underemployment and unemployment among adults with autism. Services for adults are both lacking and expensive.
In 2007, Michael L. Ganz, Ph.D. of the Harvard School of Public Health published research in the journal Archives of Pediatric and Adolescent Medicine which estimated that autism cost the United States more than $35 billion per year, and that the incremental cost of caring for an individual with autism over his or her lifetime due to their special needs was more than $3 million. Despite growing prevalence, autism currently receives less than five percent of the research funding of many less prevalent childhood diseases and disorders.
Dr. Mandell added, "We are paying for the costs of inaction and the costs of 'inappropriate action.' Social exclusion of individuals with autism and intellectual disability, and exclusion of higher-functioning individuals from employment opportunities are increasing the burden not only on these individuals and their families, but on society as a whole."
Dr. Mandell and his colleagues recently published findings in Pediatrics that mothers of children with ASD are less likely to work, work fewer hours per week and earn substantially less. Typically the primary caregiver, mothers are called upon to serve as their child's case manager and advocate, and on average, earn 56 percent less than mothers of children with no health limitations. They earn 35 percent less than mothers of children with another health limitation. They are 6 percent less likely to be employed, and they work an average of seven hours less per week.
Dr. Knapp, Professor of Social Policy at the London School of Economics and Political Science and a preeminent expert on health economics explained that the economic burden of autism varies widely across different parts of society from the individuals with ASD, their families, the communities they live in, businesses in those communities, to the government agencies which provide healthcare, education, welfare benefits, social care, and housing. "There is an immediate need for better coordination across public agencies and levels of government from local to national in the way that society structures its service delivery system; too often responses to the needs of individuals and families are piecemeal and less helpful than they could be," he concluded.

Otus mauli, which was also the first nocturnal bird of prey described in the area, lived on land and became extinct as a result of humans arriving on the island.
Twenty years ago, the German researcher Harald Pieper discovered fossil remains of a small nocturnal bird of prey in Madeira, which, until now, had not been studied in depth. The international team of palaeontologists has shown that the remains belong to a previously unknown extinct species of scops owl, which they have called Otus mauli.
"It has long legs and wings slightly shorter than the continental European scops owl from which it derives" Josep Antoni Alcover, one of the authors of the study and researcher at the Mediterranean Institute for Advanced Studies (IMEDEA), a mixed centre of the university of the Balearic Islands and the Spanish National Research Council (CSIC), said.
The result of the analysis of the proportions of the remains found, which has been published in the journal Zootaxa, reveals that Otus mauli could be a land inhabiting species that ate invertebrates and "occasionally lizards or birds."
"It is likely that their extinction is linked to the arrival of humans and the fauna they brought with them," Alcover explains. He also points out that their disappearance formed part of a pattern of extinction of the island's species, which occurred in virtually all the islands of the world.
According to researchers, amongst the causes of extinction of this scops owl, the destruction of its habitat is highlighted, as Madeira had a lot of serious fires during the seven years that followed the Portuguese arrival. Furthermore, humans brought new birds with diseases that were unfamiliar to the native species, as well as rats and mice that could prey on eggs of animals that had nests close to the ground.

Sinozich also fondly recalls, "...when he was playing in casino in Perth he won so much money and the girl who was serving wine...he asked her, 'do you have a mortgage on the house?' she said 'yes', then he wrote a cheque for AUD 600,000."
The talented, even cunning, artist worked like a Trojan horse for a fortnight and managed to produce 26 paintings that deeply explore her subject's nature, removing much of the mystic of Packer as an uncompromising media mogul. All the characters in Sinozich's work have a yarn to tell, and most aspects of his life are covered... birth, death, and much of the in between. Make no mistake, the works are smart, and unique, and are tipped to become collectors items.
The work is relatively simple, but full of life, and has been described as "traditional representational painting", which one may argue is a dying art. We think KP would have liked the tribute, and we await word to see what living members of the Packer clan think of the works.
Kerry Packer Legend To Return To Australian TV In Cleo Mini Series...
Packer is to return to life on Aussie TV via new ABC drama Paper Giants: The Birth Of Cleo (not to be confused with the Cleopatra slot game).
Australian readers may recall the public backlash to the introduction of the super sexy womens? title in 1972. There were Cleo lovers and haters, but we're still talking about it today, so it made an impact, which is better than many of today's rags.
Rob Carlton will play a young Packer opposite Asher Keddie as publishing pioneer, the sexy and smart Ita Buttrose.
Rumours of a sexual relationship between Packer and Ita around the time of Cleo magazine's start off, but this won't be a focus on the mini-series, due to air next year.
Buttrose, who first made her mark as the magazine's editor, was a consultant on the production.
"If there was a supposed affair it didn't happen in this timeframe. I have no idea if there was, we didn't raise it with her," Edwards said.
There ABC publicity brief has whet our appetite for lots of Packer classic stuff and enough scandal to keep us coming back for more.
"It's 1972. Skirts are up, pants are down. Girls can have anything: Fabulous careers, fashionable clothes and oral sex," spruiks the promo.
The drama cleverly follows the death of Sir Frank Packer and the rise of his second son, who defies even family expectation to succeed, in a way no one could have expected.
"It was a real turning point in Kerry's career. It was a period when he made his first big move and it was an astonishing success and one against the odds in some respects," Edwards said.
Cleo magazine itself was a fine, yet controversial work, and introduced the nude male centrefold and sexual hits, tips, tricks and more for women. Media Man friend, actor Jack Thompson, is tipped to have his racy centrefold recreated. Something about a 6th finger, down there.
ABC TV by all accounts have taken a calculated risk on the series. Most quarters of society, both insiders and outsiders we've chatted with believe the gamble will pay off with a tidy jackpot, and whispers already circulate as to how many awards the show and actors will pick up.
Nine's David Gyngell Respects Packer History; PBL Becomes Nine Entertainment Co...
KP put Publishing & Broadcasting Media on the map and grew it to become arguably the biggest media brands in Australia.
PBL - the name, is now history, since Bondi Beach based chief executive, David Gyngell, rebranded it with Nine Entertainment Co.
Gyngell, who announced the rebranding at Nine's 2011 program launch in Sydney on Friday, advised the new name would be more recognisable to the public and large and went on to emphasise Nine's broad range of businesses, which sport Nine, ACP Magazines, Ticketek and NineMSN.
The recognition factor is important since the firm is likely to be floated on the Australian Stock Exchange by its private equity owners, CVC Asia Pacific, in the first half of next year.
It's understood that a strong level of support from a host of retail investors will be key to the $5 billion-plus float's chances of a jackpot.
Gyngell wisely acknowledged it was not an easy decision given he is the late Kerry Packer's godson and great mate of James Packer. History buffs, just in case you wondered, PBL was formed way back in 1994 when KP merged Nine with ACP (Australian Consolidated Press).
"PBL has a long association with the Packers so personally I don't take that lightly. But it's modernising a business that needs to be publicly known. We don't have the luxury of having James Packer or another mogul giving the company real gravitas."
Other media updates down under include Network Seven being backed by Kerry Stokes and Network Ten's board now has James Packer, News Corporation director Lachlan Murdoch, mining magnate Gina Rinehart and WIN TV owner Bruce Gordon.
"Nine is the biggest thing that we have and it is also the thing that supports all the other companies in the best possible way," Gyngell said. "It will be a new year. We are starting again.
Nine confirmed its crime drama Underbelly would come back with a series set in the roaring 20s in Sydney as well as 3 Underbelly movies! And, get this, a good spot of gambling will also be featured.

In a strong rebuke to the Federal Circuit, a unanimous U.S. Supreme Court held?(pdf), on March 20, 2012, that Prometheus Laboratories? claims to methods of administering drugs to treat gastrointestinal autoimmune diseases do not meet the patentable subject matter standard of section 101 of the Patent Act.? The representative claim quoted by the Court recites, ?A method of optimizing therapeutic efficacy for treatment of an immune-mediated gastrointestinal disorder? comprising two steps: (a) administering one of a class of drugs (thiopurines) and (b) determining the level of a specified metabolite, ?wherein? a level below a given threshold ?indicates a need to increase the amount of said drug subsequently administered? [to improve efficacy], and a level above the threshold ?indicates a need to decrease the amount of said drug subsequently administered? [to avoid toxicity].
History of the Case. Mayo originally bought and used Prometheus test kits that employed the patented method, but it then decided to sell and market its own test, which was similar, but not identical.? Prometheus sued for patent infringement.? The district court found that Mayo?s test would infringe the Prometheus patents, but it then held the patents invalid as essentially claiming unpatentable laws of nature:? in this case, the relationship between the levels of the specified metabolite and the efficacy or toxicity of the relevant drugs.
The Federal Circuit reversed this decision in 2009, finding that the claims satisfied its then-controlling machine-or-transformation test.? Both the administering and determining stages, the court held, brought about a transformation of the patient?s body.? In the summer of 2010, while a Prometheus cert.petition (a request for Supreme Court review) was pending, the Supreme Court decided Bilski v. Kappos, a case involving a patent on a method of commodities hedging.? In a set of murky opinions, the Court held that the machine-or-transformation test was not the exclusive test of subject matter eligibility for method claims, but it could be helpful in appropriate cases.? Immediately thereafter, the Court ordered the Federal Circuit to reconsider its Prometheus opinion in light of Bilski.? In an opinion that might be described as perfunctory, the Federal Circuit held once more that the Prometheus patents comprised statutory subject matter, and the Supreme Court granted cert.
The Supreme Court?s Reasoning.?The Court?s opinion?(pdf) focuses on the difference between claims to laws of nature themselves and claims to specific applications of such laws: the former fail the section 101 subject matter test, while the latter pass.? The laws of nature involved here are the ?relationships between concentrations of certain metabolites in the blood and the likelihood that a dosage of a?? thiopurine drug will prove ineffective or cause harm.?? The legal question then becomes, ?do the patent claims add enough to their statements of the correlations to allow the processes they describe to qualify as patent-eligible processes that apply natural laws???For all nine members of the Court, the answer was a clear no.
The?Court?s analysis of the claims went through four steps.? First, it observed, the administering step just defines ?the relevant audience??doctors who treat patients with thiouprine drugs.? Second, ?the ?wherein? clauses simply tell a doctor about the relevant natural laws.?? Third, the determining step does not specify any particular process, but merely invites doctors ?to engage in well understood, routine, conventional activity.?? And fourth, ?to consider the three steps as an ordered combination adds nothing to the laws of nature that is not already present when the steps are considered separately.?? In sum, ?the three steps simply tell doctors to gather data from which they may draw an inference in light of the correlation.?? They ?are not sufficient to transform unpatentable natural correlations into patentable applications of those regularities.?? To allow such a patent could ?inhibit further discovery by improperly tying up the future use of laws of nature.?
What Do We Learn??The first point is that section 101 is alive and well as the first test of patentability.? Some recent Federal Circuit opinions have suggested that section 101 can and should be avoided in most cases, leaving the work of evaluating patents to sections 102 (novelty), 103 (nonobviousness), and 112 (written description).? The Court explicitly rejects that approach, refusing to let section 101, with its law of nature prohibition, become ?a dead letter.?? So the Patent Office and the courts will continue to have to make an initial determination of whether an invention comprises statutory subject matter, independent of whether it satisfies the other criteria of patentability.? Nonetheless, the language quoted above about ?well understood, routine, conventional activity? suggests that novelty and obviousness have some relevance to subject matter eligibility, despite loud protests that this conflates section 101 with issues presumably assigned to 102 and 103.
Second, although this opinion is light years ahead of Bilski in terms of clarity, it is still hard to be absolutely certain of what the subject matter test for method patents is.? We know?from the last paragraph of the opinion?that patents that ?effectively claim the underlying laws of nature themselves? are invalid.? Another version of this is that a survivable claim must ?differ significantly from a claim that just said ?apply the algorithm.?? But just how to identify such a claim is a more difficult issue.? We know that a claim structured just like Prometheus?s is invalid: that is, a claim that involves nothing more than gathering data that may provoke an inference based on a law of nature (for example, maybe, the claims upheld by the Federal Circuit on August 31, 2011 in Classen Immunotherapies, Inc. v. Biogen IDEC?).? Some additional application of the law of nature is required?but how much?
The Court rejects ?simply appending conventional steps, specified at high level of generality, to laws of nature.?? It expresses particular concern about claims so broad as to ?seek pre-empt the use? of the law of nature.? But it gives little affirmative guidance about how specific the application of the law must be, declining to speculate on precisely what additional limitations might have saved the Prometheus claims before it.
Impact on Myriad??There have already been a lot of questions raised about the impact of Prometheus on the Myriad litigation, in which a cert petition is still pending in the Supreme Court.? Does this new decision make it more or less likely that the Court will take Myriad? Does it suggest a likely outcome if the Court does take it?
Before speculating about these questions, it is important to remember that the Federal Circuit decision in Myriad addressed three separate sets of patent claims: (1) the court upheld (with a partial dissent) Myriad?s product claims on cDNA and isolated DNA; (2) the court also upheld Myriad?s claims to methods of screening potential cancer therapeutics by analyzing growth rates of cells with altered BRCA genes in the presence or absence of the treatments; but (3) the court rejected Myriad?s claims to methods of analyzing BRCA gene sequences and comparing those with cancer-predisposing mutations to normal sequences. The cert petitions filed by both sides do not address the methods claims (only the product claims and the highly technical standing issue), but the Supreme Court could order briefing and argument on any aspect of the case.
The Prometheus decision says nothing about gene product claims, so is irrelevant to issue (1) in Myriad. But it says a lot, obviously, about method claims that bear at least some structural similarity to those in Prometheus.? So does Prometheus indicate that the Court is more or less likely to review those method claims? (Warning: anyone who claims to have inside information about pending Supreme Court decisions is lying?Court security makes the old KGB look like a sieve.) Our guess (and it?s little more than that) is that the issuance of Prometheus makes it less likely that the Court would review the Myriad method claims.? It has just issued a unanimous and?by the standards of Supreme Court patent cases?relatively clear opinion on generally similar medical methods.? History suggests that is unlikely to want to revisit that topic the very next year.? Prometheus itself is an obvious exception, of course, coming right after Bilski. But the Court may have realized how unhelpful its fractured Bilski opinion was, and all of the justices apparently believed that the Federal Circuit had either failed to understand it or chosen to ignore it.? And the history of Prometheus suggests a possible pathway for Myriad: that the Supreme Court would grant cert, but (with respect to the method claims) for the limited purpose of vacating the Federal Circuit?s opinion and ordering reconsideration in light of Prometheus.
But if the Court does decide to review Myriad (or if the Federal Circuit is ordered to do it over), does Prometheus help us to predict the outcome?? The method claims that the Federal Circuit rejected ((3) above) are hard to distinguish from those in Prometheus: doctors gather information and make a straightforward comparison, using basic genetic knowledge.? Those claims are likely to be rejected once again.? The drug-screening claims that were upheld ((2) above) are a closer call.? If the ?algorithm? is the protocol for comparing the effects of treating or not treating cell lines, then ?do the patent claims add enough to their statements of the correlations [or algorithm] to allow the processes they describe to qualify as patent-eligible processes that apply natural laws??? There is a good bit of practical application going on here: cell lines must be grown and drugs applied (or not) before a judgment is made.? It looks more like a real-world pharmaceutical process than a broad statement of an algorithm.? For that reason, it seems more likely than not that this category of method claims would be upheld once again under section 101.
Conclusion. We now know considerably more about the Supreme Court?s views on methods than we did after the worse-than-useless Bilski opinion.? It is refreshing to these observers that the Court dove right back into method patents in an apparent effort to rectify the damage it did in Bilski (and there?s also some entertainment value in the revival of the Supreme Court-Federal Circuit tension that seemed to have abated a bit). But it also seems unlikely that the Court would go back to the method issue immediately, so we doubt that it will take that part of Myriad, except for the limited purpose of remanding to the Federal Circuit for reconsideration.
In terms of impact on the marketplace, there is, of course, serious impact if your business model depends on patents just like these (e.g., if you are Dr. Classen).? But for others, both in biotechnology and IT, the effect should be minimal.? Admittedly, the mere changing of the test from one that was formerly more inclusive to one that narrows eligibility is potentially destabilizing?under the former machine-or-transformation test, ?administering? and ?determining? steps were generally transformative and therefore corresponded with patent eligibility.? But the key word is potentially, since the Prometheus patents already reflected an extreme stretching of section 101?s limits, and were also?as the Federal Circuit pointed out in its 2009 opinion?highly suspect under sections 102 and 103.
